ArtistPals LLC Terms and conditions

Thank you for purchasing your ArtistPal ticket to participate in public art session. Solely for purposes of these Terms of Use (the “Terms”) and ease of reference, ArtistPals LLC is referred to herein as the “Company”. These Terms govern your use of features on www.ArtistPals.com (the “Website”) and the Pass or passes you purchased (the “Pass”), as well as the use of the Pass. Participant experience, and all content associated therewith (collectively the “Service”). By visiting the Website and/or purchasing the Pass you accept and agree to be bound by these Terms. If you do not agree to these Terms, you should not use the Service and you should not purchase the Ticket.
Definitions
- The term “Website” heareinafter shall mean: website: http://www.ArtistPal.com
- The term “Event” means the art session organised and administered ArtistPals LLC
- The term “venue” shall mean the location where the Event will take place.
- The term “Pass” shall mean a physical or electronic permission for you or a person for whom you have gifted the Pass to attend the Event
- Any references hereinafter to “you” or “your” shall mean and refer to the person who purchased the Pass, and includes any persons that eventually utilize the Pass to attend the Event in a set Venue.
- The term “ArtWork” shall mean any painting, drawing, sketch, or other creative items in company Website.

Service offering
“Company” is an event management and entertainment service that facilitate and administer an art session as “ Event” held in a set Venue in return of the “Pass” obtained by customers and attendees.
A. Availability
On rare occasions the availability of an Event in a Venue could change prior or on the day of the Event.
Or/And there can be last minute change in Artist/Instructor assigned for that Event. The company will notify you about any changes in the Venue. And while the company will do its utmost effort to have the Artist you have signed up available but the artist/instructor may change at the Company’s sole discretion without notice to you.
B.Materials Provided
Company shall provide The Materials and instruments and equipment for the Event, including but not limited to all paints, canvases, brushes, easels, aprons. The specifications of all the materials and equipment is at the sole discretion of the Company.
C. End Result
The Artist/Instructor assigned to the Event by Company will be instructing to accomplish the art as close as possible to the demo provided on the website. However the outcome of every individual is very unique to that person. The company makes to warranties about the quality of any of the outcome.
D. Start Time
The Company will do the maximum effort to start the Event on time. Occasionally events could have limited delays based upon different factors including but not limited to issue at the Venue that needs attention, Any unexpected delay in majority of the guests arrivals. However the company will make sure the time length of the Event is enough to finish the art work. The sessions will normally last for two hours however depending on unforeseeable factors the length could be shorter or longer and Company will not have any warranty to a set time length.
E. Reschedule
If you reschedule your Event more than 48 hours of the originally scheduled Event, you will not be charged any rescheduling fee. Events can not be reschedules within 48 hours to the scheduled start time.
F. Unauthorized use
Any ArtWork and materials and demos during Events or/and on Company website is belonging to the Company and should not be re-produced or copied. Work of Art that you create at your Event belongs to you however cannot be re-produced as whole and copied for any commercial or gainful purpose.
G. Pricing and promotion:
The Company will bill the Pass fee to the Payment Method you provide to the Company during your purchase of the Pass. The prices which the Pass for an Event has been obtained are conclusive. Company has the full discretion to run periodic promotion and will not warranty any price match between the purchased Pass price and promotion prices.
Occasionally we offer Promotional codes which may be redeemed on the Website. Promotional codes can only be used once and cannot be redeemed for cash, resold or combined with any other offers. A valid Payment Method will be required when you redeem the promotion code. The Company will bill your Payment Method automatically. Promotional codes may not be used in conjunction with other promotions.
H: Cancellation
No full or partial refunds are given to customers who miss an event. In term of a prior notice of more than 24 hours prior to the event you can re-schedule the Event or request a refund. In case of event cancellation by the Company for any reason, the rescheduling without any re-scheduling fee or full refund options are provided.
I. Customer reviews
The company reserves the right to promote, reject a customer review provided on company website or social media outlets. Specifically if reviews contain harsh, or discriminatory language; illegal, obscene, threatening, defamatory or otherwise objectionable content or misleading information. You understand and agree that the Company may, but is not obligated to, review the content and may delete or remove it (without notice) in the Company’s sole and absolute discretion, for any reason.
J. Age restriction
The Event is not offered to Children at the Venue unless the Event is specifically promoted and offered for Children. Regular Events are only for adults who are of the legal age of majority in the venue where your Event is being held. The Company is not responsible in any manner if persons under the legal majority age attend the Event. In any case that the Company or its employee or instructors discovers that an Event attendee is under the legal majority age in municipality where event is held, the Company or its licensee or an employee or agent of a licensee can refuse to offer instruction to any underage individual, regardless of whether that individual has a Pass to the Event or not. The Company, its staff and instructors have the right to request that you present a valid form of identification demonstrating your age, in which circumstance you agree that you will comply with such request.
K. Venue
At the venue the services which are provided by the venue including and not limited to food and beverage service, seating area, amenities including washrooms are all related to venue management. The company doesn’t not have any control over venue offering and will not endorse any specific products or services. You understand that you are responsible for all additional charges you incur at your Event, including, but not limited to food and beverage charges.
L. Intellectual Property
ArtistPals is a registered trademark. The Website, including but not limited to its graphics, logos, may not be used or reproduced without prior written approval from the Company and may not be used in connection with any product or service that is not affiliated with the Company, in any manner that is likely to cause confusion among customers, in any manner that dilutes the rights of the Company, or in any manner that disparages or discredits the Company.
M. Use of information submitted
By purchasing a pass from the Company or communicating by social media in form of message, reviews, answering polls or participating in promotional events you acknowledge and consent that company can use your contact details to reach out to you for any promotional offering.

cc. Arbitration agreement
You and the Company agree that any dispute, claim, action, or controversy arising out of or relating in any way to the Service, including the Website, user interfaces, these Terms, the Pass you purchase, and the Event shall be determined by binding arbitration instead of in courts. By assigning neutral arbitrator instead of a judge or jury..
dd. Governing Law and Venue
The Terms and the policies and procedures set forth on the Website and any and all disputes between you, including all Event Attendees, and the Company shall be governed in accordance with the laws of the United Arab Emirates.
EE. Force majeure
Neither you nor the Company shall be liable for the failure to perform any of the obligations hereunder (other than the payment of money) during any period in which such performance is delayed by fire, flood, earthquake, other natural disaster, war, embargo, riot or the intervention of any government authority, provided that the party that is unable to perform immediately notifies the other party of such inability.
